Terms of Service

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. You agree to use them only for lawful purposes and in accordance with these Terms.

You are responsible for any activity that occurs under your account and for keeping your credentials confidential. Notify us promptly of any unauthorised use.

Some features require an account or a paid subscription. You agree to provide accurate information and to keep it up to date.

Paid plans are billed through Stripe on a recurring basis until cancelled. Fees are non-refundable except where required by law or expressly stated. We may change pricing with reasonable advance notice.

You agree not to misuse the Services, including by attempting to gain unauthorised access, interfering with normal operation, reverse engineering, scraping at scale, or using the Services to build a competing product.

You may not upload unlawful, infringing, or harmful content, or use the Services to violate the rights of others.

The Services, including all software, text, and design, are owned by Telesto Tech or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Services as permitted by these Terms.

You retain ownership of content you submit to the Services. You grant us a licence to host and process that content solely to provide the Services to you.

The Services integrate third-party providers such as Stripe (payments), Sentry (monitoring), and Anthropic (AI features). Your use of those features may also be subject to the providers’ own terms, and we are not responsible for their acts or omissions.

Answers are AI-generated from public ordinance data and may be inaccurate, incomplete, out of date, or wrong. They are general information only — NOT legal, engineering, or other professional advice — and do NOT confirm that any project, use, or plan complies with the code. Nothing here creates a professional, advisory, or fiduciary relationship. You are solely responsible for independently verifying every answer against the current code and with the applicable authority having jurisdiction (AHJ) before acting, and you rely on it entirely at your own risk. To the fullest extent permitted by applicable law, Telesto Tech disclaims all liability for any use of, or reliance on, these answers.

To the maximum extent permitted by applicable law, Telesto Tech provides AI-generated answers "as is" and "as available", with no warranty of any kind — express, implied, or statutory — including any warranty of accuracy, completeness, currency, title, non-infringement, merchantability, or fitness for a particular purpose. To the maximum extent permitted by applicable law, Telesto Tech disclaims all liability for any loss, damage, injury, penalty, fine, delay, or cost — whether direct, indirect, incidental, consequential, special, exemplary, or punitive — arising from your use of, or reliance on, AI-generated answers, including any decision made or action taken based on them, even if advised of the possibility of such damages. You use these answers entirely at your own risk and remain solely responsible for independently verifying them against the current code and with the applicable authority having jurisdiction before acting. Nothing produced by the assistant constitutes legal, engineering, or other professional advice, or an official determination of code compliance, and nothing creates a professional, advisory, or fiduciary relationship of any kind.

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content, answer, or figure they produce is accurate, complete, or current.

The City Code assistant and its tools are a reference aid only. Their answers, calculators, and figures are general information — not legal, engineering, or other professional advice, and not an official determination that any project, use, or plan complies with the applicable code. AI-generated output may be inaccurate, incomplete, out of date, or fabricated, and municipal codes change frequently. You are solely responsible for independently verifying any output against the current code and with the applicable authority having jurisdiction before relying on it, and you do so at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

You acknowledge that decisions about construction, permitting, filings, purchases, zoning, and legal compliance carry significant financial and legal consequences, and that these should be made in consultation with the applicable authority having jurisdiction and, where appropriate, a qualified professional. You assume all risk arising from any decision made or action taken based on the Services, and you agree not to treat any output as a substitute for professional advice or an official determination.

To the maximum extent permitted by applicable law, in no event will Telesto Tech, its owners, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any penalty, fine, or cost, arising from or related to your use of, or inability to use, the Services or any answer, tool, or content they provide, even if we have been advised of the possibility of such damages, and regardless of the theory of liability.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars (US$100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

You agree to defend, indemnify, and hold harmless Telesto Tech and its owners, employees, and suppliers from and against any claims, liabilities, damages, losses, penalties, fines, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, any decision or action you take based on their output, your violation of these Terms, or your violation of any law or the rights of any third party.

We may suspend or terminate your access to the Services at any time if you breach these Terms or if we discontinue a feature. You may stop using the Services at any time. Provisions that by their nature should survive termination — including the disclaimers, assumption of risk, limitation of liability, indemnification, and governing-law provisions — will survive.

If any provision of these Terms — including any part of the disclaimers or limitation of liability — is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Denver, Colorado.

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
